These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your access to and use of the ExamsGyan website, mobile applications, AI-powered educational services, learning resources, practice systems, examination features and related services.

By creating an account, accessing or using ExamsGyan, purchasing a plan, or using any of our services, you agree to be bound by these Terms and Conditions.

If you do not agree with these Terms, please do not use the applicable ExamsGyan services.

1. About ExamsGyan

ExamsGyan is an educational technology platform designed to assist students, parents, educators and other learners with educational preparation and learning activities.

Our services may include:

  • Educational study material
  • Subject and chapter-based learning
  • Practice questions
  • Quizzes
  • Mock examinations
  • AI Tutor
  • AI-generated notes
  • AI-generated questions
  • AI-generated explanations
  • Learning progress
  • Educational resources
  • Student accounts
  • Parent accounts
  • Paid AI plans
  • Other educational tools and services

Features may be added, modified, suspended or discontinued from time to time.

2. Eligibility

You may use ExamsGyan only if you are legally permitted to enter into these Terms.

Students who are minors should use the service with appropriate involvement, authorization or supervision of a parent, guardian, school or other authorized adult, as applicable.

Parents or guardians are responsible for supervising a minor’s use of online services where appropriate.

By creating an account, you confirm that the information you provide is accurate and that you are authorized to use the account.

3. Account Registration

Certain ExamsGyan features require an account.

When registering, you may be required to provide:

  • Full name
  • Email address
  • Mobile number, where applicable
  • Account type
  • Password
  • Other information necessary to create your account

You agree to provide accurate and current information.

You are responsible for maintaining the confidentiality of your login credentials.

You must not:

  • Share your password with another person
  • Allow unauthorized persons to use your account
  • Sell or transfer your account
  • Attempt to access another person’s account
  • Use another person’s credentials
  • Create accounts for fraudulent purposes

You are responsible for activity occurring through your account unless the activity resulted from circumstances outside your reasonable control and was promptly reported to us.

4. Account Security

You should use a strong password and protect your login credentials.

ExamsGyan will not intentionally ask you to provide:

  • Your password
  • OTP
  • CVV
  • UPI PIN
  • Complete payment-card credentials

through unsolicited communications.

If you believe that your account has been compromised, you should contact us as soon as reasonably possible.

5. Educational Purpose

ExamsGyan is an educational assistance platform.

Our services are intended to support learning, practice and examination preparation.

ExamsGyan does not guarantee that using our platform will result in:

  • Passing an examination
  • Achieving a particular grade
  • Obtaining admission
  • Obtaining employment
  • Achieving a particular academic result
  • Improving examination scores by a specific amount

Individual results depend on many factors, including the user’s effort, preparation, educational background and examination requirements.

6. AI Tutor and AI-Generated Content

ExamsGyan may provide AI-powered educational functionality.

The AI Tutor and related features may generate:

  • Answers
  • Explanations
  • Questions
  • Notes
  • Summaries
  • Study plans
  • Practice material
  • Other educational content

AI-generated content may contain errors, inaccuracies, outdated information or inappropriate interpretations.

You should independently verify important information using:

  • Official textbooks
  • School or college materials
  • Official examination-board resources
  • Teachers
  • Qualified educators
  • Other reliable sources

ExamsGyan does not guarantee that every AI-generated answer or explanation will be accurate or complete.

AI-generated content should not be treated as a substitute for a qualified teacher or official educational source.

7. Appropriate Use of AI

The AI features are intended primarily for educational purposes.

Users must not intentionally use the service to generate or request unlawful, harmful or inappropriate material.

Users must not attempt to bypass technical restrictions, AI credit limits, safety controls or other platform restrictions.

We may restrict or suspend AI access where we reasonably believe the service is being abused.

8. Free AI Usage

ExamsGyan may provide a limited free AI usage allowance to eligible accounts.

Unless otherwise stated on the website, a free account may receive one lifetime free AI generation.

The free allowance:

  • Is associated with the applicable user account
  • Is not transferable
  • Has no cash value
  • Cannot be exchanged for money
  • Cannot be sold
  • Cannot be transferred to another account

ExamsGyan may take reasonable measures to prevent abuse of free usage.

Creating multiple accounts to circumvent free-use limitations may be considered misuse of the service.

9. Paid Plans and AI Credits

ExamsGyan may offer paid plans such as Pro and Expert.

Current plan details displayed on the website may include:

Pro

  • 30-day access
  • 200 AI credits

Expert

₹299

  • 30-day access
  • 400 AI credits

Plan prices, durations, credits and features may change in the future.

The applicable plan details displayed at the time of purchase will generally govern that transaction.

10. AI Credits

AI credits are usage units used for eligible AI features.

Credits:

  • Are associated with the applicable account
  • Are not cash
  • Cannot be withdrawn as money
  • Cannot normally be transferred between users
  • Cannot be sold or exchanged
  • May expire with the applicable plan where specified
  • May be subject to reasonable technical usage restrictions

The number of credits consumed by a particular AI feature may depend on the feature and the applicable system rules.

ExamsGyan may modify credit consumption rules where reasonably necessary, including for technical, security or service reasons.

11. Plan Activation

Paid plans are activated after successful payment verification.

ExamsGyan may use server-side verification and payment-provider information to confirm a transaction.

A payment may not immediately activate a plan if:

  • Payment verification is incomplete
  • The payment fails
  • The payment is reversed
  • The transaction is identified as fraudulent
  • Technical verification is temporarily unavailable

If you have been charged but your plan has not been activated, contact us with the relevant transaction information.

12. Payments

Payments for paid ExamsGyan services may be processed through Razorpay or another payment provider designated by ExamsGyan.

The payment provider may process payment information according to its own terms and privacy policy.

ExamsGyan does not intend to collect or store:

  • Full card numbers
  • CVV
  • UPI PIN

through its own application systems.

Payment-related transaction information may be retained for legitimate purposes such as:

  • Payment verification
  • Accounting
  • Customer support
  • Fraud prevention
  • Refund processing
  • Legal compliance
  • Transaction reconciliation

13. Payment Verification and Security

For payment security, ExamsGyan may verify transactions through server-side systems.

This may include verification of:

  • Order ID
  • Payment ID
  • Amount
  • Currency
  • Payment status
  • Payment signature
  • Payment-provider webhook information

Users must not attempt to manipulate, forge or bypass payment verification.

14. Refunds

Refunds are governed by the ExamsGyan Refund Policy.

A refund may be considered in circumstances described in that policy, including certain:

  • Duplicate payments
  • Successfully completed payments where the purchased service was not made available
  • Other circumstances required by applicable law

Digital services may have limited refund eligibility after access to or consumption of the service, including use of AI credits.

We may require transaction information to investigate a refund request.

Refunds, where approved, may be processed through the applicable payment method or payment provider.

15. Fraudulent or Unauthorized Transactions

If we reasonably suspect that a transaction is fraudulent, unauthorized or associated with abuse, we may:

  • Delay activation
  • Suspend an account
  • Restrict access
  • Investigate the transaction
  • Request additional information
  • Reverse or cancel access where appropriate
  • Cooperate with payment providers or lawful authorities

Nothing in this section limits rights available under applicable law.

16. Acceptable Use

You agree to use ExamsGyan only for lawful and appropriate purposes.

You must not:

  1. Violate applicable laws or regulations.
  2. Attempt to gain unauthorized access to the website or servers.
  3. Attempt to access another user’s account.
  4. Circumvent authentication systems.
  5. Circumvent AI credit restrictions.
  6. Abuse free AI allowances.
  7. Use automated systems to overload or attack the service.
  8. Scrape substantial portions of the website without authorization.
  9. Reverse engineer protected components except where legally permitted.
  10. Upload malicious software.
  11. Attempt SQL injection or other attacks.
  12. Attempt to interfere with payment processing.
  13. Submit fraudulent payment information.
  14. Impersonate another person.
  15. Use the platform for unlawful activities.
  16. Abuse customer-support systems.
  17. Attempt to defeat security or rate-limiting systems.
  18. Use the service to distribute malware or harmful code.
  19. Use AI features to generate unlawful or harmful content.
  20. Use the service in a way that interferes with other users.

17. Academic Integrity

ExamsGyan is intended to support legitimate learning.

Users are responsible for following the academic-integrity rules applicable to their school, college, examination board, university or other educational institution.

You must not use ExamsGyan to:

  • Cheat in examinations
  • Circumvent examination security
  • Impersonate another student
  • Submit another person’s work as your own
  • Violate examination rules
  • Obtain unauthorized assistance during restricted examinations

AI-generated material should be used responsibly and in accordance with the rules of the relevant educational institution.

18. User-Submitted Content

Users may submit information or content such as:

  • Questions
  • Answers
  • Notes
  • Educational material
  • Feedback
  • Other information necessary to use the service

You remain responsible for content you submit.

You must have the necessary rights or permissions to submit material that you upload or provide.

You must not upload content that:

  • Infringes another person’s intellectual-property rights
  • Contains malware
  • Contains unlawful material
  • Contains unnecessary sensitive personal information
  • Violates another person’s privacy
  • Is intended to compromise the service

19. Intellectual Property

The ExamsGyan website, software, design, branding, logos, original educational material, databases, graphics, text, interface and other original content may be protected by intellectual-property laws.

Unless otherwise stated, these rights belong to ExamsGyan or the applicable rights holder.

You may use the service for personal educational purposes in accordance with these Terms.

You must not reproduce, distribute, sell, publicly display, commercially exploit or create derivative works from protected ExamsGyan material without appropriate authorization, except where permitted by applicable law.

20. Third-Party Educational Content

Some educational material may be provided by third parties or may reference external educational resources.

ExamsGyan does not necessarily endorse every third-party resource.

Third-party content may be subject to separate terms and copyright restrictions.

21. User Feedback

If you voluntarily submit suggestions, feedback or ideas about ExamsGyan, you grant us permission to use that feedback for purposes such as improving our services, without creating an obligation to compensate you, unless otherwise required by law.

22. Service Availability

We aim to keep ExamsGyan available and reliable, but we do not guarantee uninterrupted or error-free operation.

The service may occasionally be unavailable because of:

  • Maintenance
  • Updates
  • Server problems
  • Hosting problems
  • Network failures
  • Security incidents
  • Third-party service failures
  • Payment-provider outages
  • Internet disruptions
  • Circumstances beyond our reasonable control

We may temporarily suspend certain services when necessary for security, maintenance or technical reasons.

23. Changes to the Service

We may modify, add, remove or discontinue features from time to time.

This may include changes to:

  • Credit consumption
  • Plans
  • Pricing
  • User interface
  • Account functionality

Where appropriate, material changes affecting existing paid services will be handled in accordance with applicable law and the applicable purchase terms.

24. Account Suspension or Termination

We may suspend or terminate an account where reasonably necessary if:

  • The user violates these Terms
  • The user engages in fraud
  • The account is compromised
  • The user attempts to attack or compromise the platform
  • Payment abuse is detected
  • The service is being used unlawfully
  • The user attempts to circumvent technical restrictions
  • Suspension is necessary to protect other users or the platform

Where appropriate and legally required, we may provide notice or an opportunity to resolve the issue.

Termination or suspension does not necessarily eliminate obligations that arose before termination.

25. Consequences of Account Termination

If an account is terminated or deleted:

  • Login access may stop.
  • Saved learning information may become unavailable.
  • Unused AI credits may become unavailable.
  • Paid access may be terminated where permitted by applicable terms.
  • Certain records may be retained where required by law or necessary for legitimate purposes.

Refund eligibility, if any, will be determined under the applicable Refund Policy and applicable law.

26. Privacy

Your use of ExamsGyan is also governed by our Privacy Policy.

27. Security

You must not attempt to compromise the security of ExamsGyan.

This includes attempting to:

  • Access restricted systems
  • Obtain administrator credentials
  • Modify database records without authorization
  • Circumvent authentication
  • Attack APIs
  • Upload malicious code
  • Exploit vulnerabilities
  • Interfere with payment verification
  • Circumvent access restrictions

If you discover a potential security vulnerability, please report it responsibly to us rather than exploiting it.

We do not control third-party websites and are not responsible for their:

29. Disclaimer of Warranties

To the extent permitted by applicable law, ExamsGyan is provided on an “as available” and “as is” basis.

We do not guarantee that:

  • The service will always be error-free.
  • AI-generated content will always be accurate.
  • Educational content will always be complete or current.
  • The service will meet every user’s particular requirements.
  • The service will produce a particular academic result.

Nothing in these Terms excludes a legal right or protection that cannot lawfully be excluded.

30. Limitation of Liability

To the maximum extent permitted by applicable law, ExamsGyan and its operators will not be responsible for losses arising from matters beyond our reasonable control, including:

  • Internet failures
  • Third-party service failures
  • Payment-provider outages
  • Device problems
  • Unauthorized access resulting from compromised user credentials
  • Incorrect information provided by users
  • Reliance on inaccurate AI-generated information
  • Examination results
  • Academic results
  • Admission decisions
  • Employment decisions

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

31. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses or claims arising from your unlawful use of ExamsGyan, violation of these Terms, infringement of third-party rights or misuse of the service.

This provision does not apply to the extent that applicable law prohibits such an obligation.

32. Changes to These Terms

We may update these Terms from time to time.

When changes are made, we may update the Effective Date shown at the beginning of the Terms.

Material changes may also be communicated through the website, application or other appropriate means where required.

Your continued use of ExamsGyan after applicable changes take effect constitutes acceptance of the updated Terms to the extent permitted by law.

33. Governing Law

These Terms shall be interpreted in accordance with the applicable laws of India, subject to applicable consumer-protection and other mandatory legal rights.

Any dispute shall be subject to the jurisdiction of the courts having appropriate jurisdiction under applicable law.

34. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

35. Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy and other applicable policies referenced on the ExamsGyan website, constitute the applicable agreement governing your use of the relevant ExamsGyan services, subject to any additional terms presented for specific services.
